| HIST | This will mentions the James family several times. I am not positive that this is the correct Nancy James that married Thomas N. Johnson. It needs more research: WILL OF THOMAS NIGHTINGALE JOHNSON In the Name of God Amen, I Thomas Nightingale Johnson of Claredon County and State of South Carolina, being Sound both in body & mind but knowing the uncertainty of life and the Certainty of Death and wishing to arrage my worldly affairs. so as at any time to meet the approaching Hour of Death undesturbed by eathly cares, I make and declare this to be my last and only will and Testament. First I desire that my body be decently Burried at the discretion of my Executors hereafter to be mentioned Secondly I give and bequeath to my beloved Wife Mary all the property real & personal which I got by her with the increase of the negroes also the plantation whereon I now reside Together with its appendages, in lew of two small tracts which she brought in but which I have since sold also Ten Milking Cows & Calves, the Stock of Hog and sheep the plow Horses, all the Carriage Horses, Carriage and Chair, a wagon and gears, plows plow stocks and every other plantation Tool necefsary for c!!!arring on Businefs also all the plate Kitchen and Household Furniture to be to her and her Heirs forever, but when I say all the Stock of Hogs and sheep I only mean those that belong to the Springfield plantation, and it is my desire that as soon after the Crop is Finished gathering & ginning as pofsible which may be on hand at the Time of my dissolution, that the Negroes, Which Come by my present Wife be returned to this plantation and all the rest be sent to Jacks Creek there to remain except any two which Mrs Johnson may Choos to retain for the purpose of attending my Daughter- Item, I Desire that all the Remainder of my Stock of Horses, Sheep and Wearing apparel Guns, Pistols, and every other Superflus article that my Executors may think uselefs. be emedeately Sold to the Highest bidder upon such terms as my Exors. May think proper, Item, after my Death and in Case then in the ground the Superflus Stock and the debts due which I request may be Emedeately Collected are not Sufficient, then it is my wish that they would sell as many Negros as would amount to the Defecientcy as I sould not wih My Exors. to pester themselves with working out my Debts, - (Item) I give and bequeath to John Millen Son of William and Elizabeth Millen for the affection I bear his Father Two thousand Dollars, to be paid him on the day he shall arive at the age of twenty one but if he should Sooner Die then the Same to remain as a part of my Estate as his other children will be Sufficiently provided for, (Item) I desire that my Exors, will give My Daughter as good Education as her mothers Indulgence and Tendernefs will admit her to gett, and that they do pay her Mother two Hundred Dollars pre annum, in lew of Board & Clothing (Item) I desire that after My Debts Shall be paid whatever Surplus, there may be of the annual income of my Estate the Same Shall be put at Interest at the Discretion of my Executors -(Item) I give and bequeath to my beloved Daughter Sarah to her & the Heirs of her body lawfully begotten. all the rest and residue of my Estate whaeresoever it may be found both real and personal but in case of her Death before marriage then I direct that! ! ! the property both real and personal which I Received by the death of my former Wife Nancy James, Except Such part as I have already Disposed, of do direct to the Heirs of late Colo John James, to be to them and their Heirs forever and to be divided amongh them in Such manner as they may choose and the rest of my property both real and personal to be sold for Cash one Fourth of which with what may be accumelated, to be to my beloved Wife Mary one Fourth to the orphan House establishment in Charleston and the remainder to my Father if he Survives me if not to his Heirs, Share and share alike (Item) I had almost forgot My affectionate Sister Elizabeth James, whose tendernefs of heart and attention to me in repeated Spells of Sicknefs, not only Intitles her to my best thanks but to a more pecunary remembrance and as I know her Fondnefs for Reading I think nothing would be more greatfull to her than a Library, I therefore Desire that my Exors would pay her one hundred Dollars, to ! ! ! be laid out in Books, - I also give My Dearly beloved Sister Jane McCrady two hundred Dollars to purchase her a Chair Horse, - lastly I nominate and appoint my husty Friends Matthew James, Charles Cannon and my affectionate Brother Dtr. Joseph Johnson to be my Executors, the former I would wish to take intire charge of that part of my estate left his Sister Mrs Cannons I Beg would take Intire Charge of Businefs at Jacks Creek and my Brother Joseph of what will necefsarly require to be done in Charleston Witnefs my hand and Seal this twenty Second day of May one thousand eight Hundred and one, Signed Sealed and acknowledged in presence of, Willm Sims Cleresa James Mary Sims, I omitted to mention in the proper place that is my will that should my Daughter Marry and have at her Death a Husband & no children that her Husband shall have the profits & use of the Estate during his lifetime and should she leave a Husband & Children then the Husband shall have the profitt & use of it untill her children marry or Come of age- Thomas N Johnson (Seal) Item I will and bequeath to my beloved wife Mary Johnson my Carpenter Fellow William & Direct that as soon as pofsible my Exors will buy two prime fellows, from the produce of the crop at Jacks Creek & give them to my wife to be her & her Heirs for ever and in Case of My Daughters Death as above the one Fourth left to the orphan house shall not be Disposed of as there Directed but shall be paid to my Wife in addition to the one fourth above mentioned - as Witnefs My hand this Tenth day of August one thousand Eight Hundred & two Signed Sealed & acknowledged in presence of Elesa James Cleresa James.
